These Terms of Use ("Terms") govern your access to and use of brainhealth.news, the newsletter published at that domain, and any related communications, pages, or services we offer (together, the "Service"). The Service is operated by Michael Cummings ("BrainHealth.news," "BHN," "we," "us," or "our").Read these Terms carefully. By visiting the site, subscribing to the newsletter, or otherwise using the Service, you accept and agree to be bound by these Terms and our Privacy Policy. The Service is available to users who are 16 years of age or older. By using the Service, you represent and warrant that you are at least 16 years old and that you have the legal capacity to enter into these Terms. If you do not meet these requirements, do not use the Service.
We may revise these Terms from time to time at our sole discretion. The most current version will always be posted at the URL where you found this document, with the "Last updated" date at the top. Material changes will be summarized to subscribers in the next issue of the newsletter. Your continued use of the Service after a change takes effect means you accept the revised Terms. If you do not agree to a change, your sole remedy is to stop using the Service and unsubscribe.
BrainHealth.news is a free weekly email newsletter on the neuroscience of cognitive performance, plus the website at brainhealth.news where issues are archived. We use beehiiv, Inc. ("beehiiv") as our publishing platform; your subscription is delivered through beehiiv's infrastructure, and beehiiv's own Terms of Use and Privacy Policy apply to your use of the beehiiv-hosted pages and features.The Service is currently free. There is no paid tier. If we add a paid tier in the future, separate terms specific to the paid tier will be presented at the point of purchase, and those terms will apply in addition to (and where conflicting, in place of) these Terms for paid features.We may change, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any change, suspension, or discontinuation.
You subscribe by entering your email address on a BHN signup form or by importing yourself through a beehiiv-supported flow (referral, recommendation, etc.). By subscribing, you consent to receive the newsletter and any transactional emails attached to your subscription (welcome series, referral fulfillment, occasional administrative notices about BHN itself).You can unsubscribe at any time using the link at the bottom of every issue, or by emailing us. Unsubscription is processed immediately and removes you from future sends.

At launch, BrainHealth.news runs no sponsor placements, affiliate links, or paid promotions of any kind. We do not receive compensation, in cash or in kind, for any product, supplement, service, or brand mentioned in any issue. If this ever changes, the change will be reflected in these Terms and our Privacy Policy, disclosed in-issue at the point of any sponsored placement, and summarized to subscribers in advance.

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. Without limiting the foregoing, we may terminate your access if we believe, in our sole judgment, that you have violated these Terms.Upon termination, your right to use the Service ceases immediately. The provisions of these Terms that by their nature should survive termination will survive, including (without limitation) Sections 5 (No advice), 7 (Intellectual property), 12 (Warranties), 13 (Liability), 14 (Indemnification), and 17 (Governing law).You may end your relationship with us at any time by unsubscribing from the newsletter.
The Service is operated from the United States. We make no claim that the Service is appropriate or available for use in any particular location. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws, including any applicable export or import restrictions.
These Terms, and any dispute or claim arising out of or related to them or to the Service (including non-contractual disputes or claims), are governed by the internal laws of the State of California, without regard to its conflict of laws principles.Any legal action or proceeding arising out of or related to these Terms or the Service will be brought exclusively in the state or federal courts located in Alameda County, California, and you consent to the personal jurisdiction and venue of those courts.
Any cause of action or claim you may have arising out of or related to these Terms or the Service must be commenced within one (1) year after the cause of action accrues. Otherwise, the cause of action or claim is permanently barred.
No waiver by us of any term or condition of these Terms will be deemed a further or continuing waiver of that term or any other term, and our failure to assert any right or provision will not constitute a waiver of that right or provision.If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision will be eliminated or limited to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
These Terms, together with our Privacy Policy and any other notices we publish at brainhealth.news, constitute the entire agreement between you and BrainHealth.news regarding the Service and supersede all prior agreements, understandings, and representations (whether written or oral) on the subject. Where the Service is delivered through beehiiv, beehiiv's own Terms of Use and Privacy Policy also apply to your interaction with beehiiv-operated pages and features.
